Distance Sales Contract

  1. Persons under 18 years of age may not shop at Librakons. Librakons.com offers products for children but sells them to adults.
  2. Librakons can be purchased by credit card (Visa, MasterCard) or bank transfer. Orders not remitted within one week will be canceled. Orders are processed when the order amount is debited from the credit card account, not when the order is placed. Unspecified payment methods such as postage prepaid or postal checks are not accepted.
  3. Librakons will deliver all your orders accompanied by an invoice with delivery note as required by law. Gift packages will be sent with a delivery note and the invoice will be mailed to the invoice address. All prices for purchases are expressed in TL. VAT rates are 8% for books, 1% for magazines, 18% for music, video, cybermarket products and shipping, and 26% for hobby products.
  4. Librakons is responsible for price inaccuracies caused by typographical and system errors.
  5. Circumstances which did not exist and were not foreseen at the time of signing the contract, which are beyond the control of the parties, which make it impossible for one or both of the parties to fulfill their obligations and responsibilities undertaken by the contract partially or completely or to fulfill them on time, will be accepted as force majeure (Natural disaster, war, terrorism, insurrection, provisions of legislation, seizure or strike, lockout, significant malfunction in production and communication facilities…). The party in whose person the force majeure event occurs shall notify the other party immediately and in writing. During the continuation of force majeure, the parties shall not be liable for any failure to fulfill their obligations. If this force majeure event continues for 10 (ten) days, each party shall be entitled to terminate unilaterally.
  6. If you have placed your order by selecting the bank transfer option, only the product costs will be refunded in case the products are not available. Librakons has nothing to do with the transfer fees charged by banks. Therefore, we recommend that you make your remittance payments through the banks’ internet branches and ATMs.
  7. The delivery of a collected order is made by Domestic Cargo, MNG Cargo and PTS Express if it is within Turkey and by Overseas-Postal Service, ASP or private courier company PTS Worldwide Express if it is outside Turkey. Click here for detailed information about shipping.
  8. In case your packages are not delivered within the deadlines specified to you during your shopping, you can send an e-mail to [email protected]. The package can be tracked by calling the Cargo Company by us or by the customer. Once the package is received, it is deemed accepted that the delivery company has done its duty properly. Therefore; Packages found to be damaged during delivery should not be accepted and a report should be kept. The report should then be reported via an e-mail to [email protected]. Librakons will re-supply the product and arrange a repeat delivery as soon as possible.
  9. The customer has the right to withdraw from the contract by refusing the goods or services within fourteen days from the date of receipt or signing of the contract without any legal and criminal liability and without any justification, and Librakons undertakes to take back the goods from the date of receipt of the withdrawal notification to the seller / provider…As legally regulated, the right of withdrawal cannot be used for products that cannot be returned due to their nature, disposable products, copyable software and programs, products that deteriorate quickly or expire. The exercise of the right of withdrawal in such products is subject to the condition that the packaging of the product is unopened, intact and the product has not been used. In case of exercising the right of withdrawal, the original invoice must be returned. The product price will be refunded to the customer within 7 days following the receipt of these documents and the product(s) by Librakons.   10. Your credit card information is not stored in the system. After placing an order, if you check the save box on the right line after entering the credit card information on the payment information screen, the card information will be saved in our system, you can view this card again in your next orders and speed up the order process. When you want to delete your registered card or update its information, you can perform the transactions by accessing the My Credit Cards section from the My Membership Information page. Your card number is also hidden on these screens for your security.
  11. Due to the possibility of changes in Librakons import and export regulations, we recommend that you contact [email protected] for international orders.
  12. The customer accepts and declares that he/she has read the essential information regarding the essential qualities, features, sales price including VAT, payment and delivery method and supply and delivery times of all products that constitute the subject of the contract on the website www.Librakons.com and that he/she has all the information about the products and that he/she has given his/her consent to purchase electronically in line with this information. SHIPPING

1. Shipping options are offered to our customers during the order.
2. Librakons may change the shipping company for faster delivery when necessary. Librakons does not charge an additional fee for changes made for customer satisfaction.
3. Average delivery times: Estimated 1-3 days with Special Shipping Company.

II – Outside Turkey

1. Shipments out of Turkey from Librakons are carried out by private courier company APS, PTS Worldwide Express or Overseas-Postal Service(15-21 days).
2. Shipments with PTS Worldwide Express are insured for the value of the package.

III – Determination of cargo rates

There are three parameters that determine the shipping cost.

1. Total weight of your selected products. (The total weight is automatically calculated during the ordering process using the weight of each product stored in the database).
2. Where your package will be delivered. (Tariffs for domestic and international shipments are different. Tariffs vary according to countries for shipments outside Turkey).
3. The delivery company of your choice for shipments within Turkey.

During the order process, the shipping company and fee options are announced on the shipping page after the address stage.

Librakons acts within the framework of the Consumer Protection Law No. 4077 in return transactions.

Product returns and conditions that you can make without any justification

You can return any product you have purchased from Librakons within 14 days from the date of delivery, even if the product is not damaged, without giving any reason.

We undertake that the consumer has the right to withdraw from the contract by refusing the goods or services within fourteen days from the date of receipt or signing of the contract without any legal and criminal liability and without any justification, and we undertake to take back the goods from the date of receipt of the withdrawal notification.

For a return, your purchase must be undamaged, unused or of unimpaired resalability.

  • The product return, which you can make without any justification, must be carried out in the condition in which the product was delivered to you. In the event that any deterioration, opening, breakage, tearing, tearing, lack of accessories and other cases are detected in the product or product packaging you have purchased, the return of the product is strictly not accepted.

  • The products to be returned must be delivered together with the original product invoice. In case of exercising the right of withdrawal, the original invoice must be returned. The product price will be refunded to the customer within 7 days following the receipt of these documents and the product(s) by Librakons. However, if the customer does not send the original invoice, VAT and other legal deductions, if any, cannot be refunded to the customer.
  • It is not possible to return services that are performed instantly in electronic media and goods delivered to the consumer instantly, goods produced in accordance with the special requests and demands of the consumer or goods that are personalized by making changes or additions, copyable software, programs, disposable goods that cannot be returned due to their nature, and goods that are likely to deteriorate rapidly or expire.
  • Unjustified returns must be made in writing and within 14 days of the delivery of the goods to you.
  • The products to be returned must be delivered to us through the cargo companies that Librakons works with.
  • The product must be placed in a package protective packaging and the shipping company’s label must not be on the product packaging. Deformation of the packaging of the product is among the situations that prevent the resale of the product.
  • Product returns that do not meet the conditions stated above are not accepted.
  • If the product return is carried out in accordance with the above-mentioned conditions, the product price subject to the return transaction will be defined as a Librakons sales gift voucher within 3 business days at the latest.

Special products

For some special categories of products, in addition to the above, the following warnings should also be taken into account:

DVD/VCD: Unpacked products cannot be returned under any circumstances, except in the case of a defective product.

Music: Unpacked products cannot be returned in any way, except in the event that the product is defective.

Return conditions for defective/damaged/defective (defective) products

Goods that are contrary to the quality or quantity affecting the quality or quality determined in the packaging, label, introduction and user manual or advertisements and announcements or notified by the seller or in the standard or technical regulation, or that contain material, legal or economic deficiencies that reduce or eliminate their value in terms of allocation or intended use or the benefits that the consumer expects from them are considered defective goods.

The consumer is obliged to notify the seller of the defect within thirty days from the date of delivery of the goods.

In this case, the consumer has the right to return from the contract, including the return of the price, replacement of the goods with a defect-free equivalent or a price reduction in proportion to the defect or free repair. The seller is obliged to fulfill this request preferred by the consumer. Along with one of these optional rights, the consumer also has the right to demand compensation from the manufacturer-manufacturer in cases where the defective goods cause death and/or injury and/or damage to other goods in use.

  • All industrial goods you buy from Librakons are under the guarantee of the manufacturer or importer company.
  • If the product you have purchased is defective, please notify Librakons in writing within 30 days from the date of delivery.
  • You can repair your product by going to the nearest authorized technical service and thus save time. (Please refer to the product’s warranty certificate and user’s manual).
  • If the product you purchased is delivered to Librakons on the grounds that it is defective, the following procedures are applied:
    Products delivered to Librakons on the grounds that they are defective are processed within 3 business days at the latest from the date of receipt.
    – Products sent on the grounds that they are defective are received by the responsible person and recorded in the company records.
    – The fault with the product is detected, and if the product is a technology product and there is an obvious fault, it is tested by the authorities of the technology shop.
    – Products sent due to defects are sent to the authorized technical service or the supplier company no later than 3 business days after the date of receipt by Librakons. The length of time the product stays in the authorized technical service or the supplier company may vary depending on the characteristics of the product.
    – The information and results (repair or replacement) received from the authorized technical service or representative organization regarding the product are communicated to you by phone or e-mail.
    – At the end of the period in the authorized technical service, the repaired product is sent to you in its repaired state, and the product, which is deemed to be suitable for return, is replaced with a new one-to-one replacement or refunded within the scope of your request. If a refund is requested, the price of the defective product is sent to your account within 3 business days at the latest.
  • Product shipments made to Librakons on the grounds that they are defective must meet the following conditions:
    – The product return section on the back of the invoice must be filled in completely.
    – The fault or problem with the product must be clearly explained.
    – The product must be shipped with all accessories and the original box.
    – The product must be placed in a suitable package that protects the package and the label of the shipping company must not be on the product packaging.
    – The product must be delivered to us via the cargo companies that Librakons works with. The shipping fee for the products delivered to us within the first 14 days from the delivery date will be covered by Librakons.

Warranty certificate for industrial goods and its duration

Manufacturers or importers are obliged to issue a warranty certificate approved by the Ministry of Industry and Trade for the industrial goods they import or produce. The warranty period starts from the date of delivery of the goods and is a minimum of two years.

All industrial goods you purchase from Librakons are under the guarantee of the manufacturer or importer company.

  • Please check the warranty certificate of the product you have purchased, including the date and number of the invoice. (For the goods that have to be sold with a warranty certificate and their warranty periods, see: Regulation on the Principles of Implementation of the Warranty Certificate published in the Official Gazette dated 14.06.2003 and numbered 25138) Introduction and user manual for industrial goods It is obligatory to sell domestically produced or imported industrial goods with a Turkish manual on the introduction, use, maintenance and simple repair and, where necessary, with a label covering international symbols and signs.
  • Please check the instructions for use for the industrial product you have purchased.
  • Malfunctions arising from the use of the product contrary to the points in the introduction and user manual are not covered by the warranty. After-sales services/Service stations
Manufacturers or importers are obliged to provide maintenance and repair services for the industrial goods they sell, produce or import by keeping sufficient technical personnel and spare parts stock for the lifetime of the goods determined by the Ministry of Industry and Trade.

In the absence of a service station at the location of the consumer, the service station nearest to the consumer is responsible for providing after-sales services.

Service stations are obliged to prepare the service receipt for the defective goods delivered to them and give it to the consumers.

During the lifetime, the maintenance and/or repair period of the goods shall not exceed 30 working days from the date of notification of the malfunction of the goods to the service station within the warranty period and 30 working days from the date of delivery of the goods outside the warranty period.

Regarding the installation, maintenance and repair service provided by the service stations, no service fee can be charged if the same malfunction recurs within one year. Failures caused by the consumer’s use of the goods contrary to the points in the user manual are not covered. Problems arising from delivery

For shipments made by private cargo companies, if the package is damaged during transportation, the damage will be compensated by Librakons. (This coverage is not available since the Overseas Postal Service sends uninsured shipments)
In case of damaged package;

– Damaged packages should not be received and a report should be made to the delivery company.
– If the delivery company official thinks that the package is not damaged, you have the right to have the package opened to check that the products have been delivered undamaged and to have the situation recorded in a report.
– Once the package has been received by you, it is deemed accepted that the delivery company has done its duty properly.
– If the package is not accepted and a report is made, this must be reported to Librakons as soon as possible, together with your copy of the report. Librakons will ensure a new and healthy delivery as soon as possible.
